Moveable Signs

Alexandrina Council’s Signs, Banners and Flag Policy and Council’s By-Law No 4 – Moveable Signs are designed to assist in creating a community of equality and commercial fairness for all businesses, community groups and services through management of on-site signage and business advertising, whilst protecting the character of our townships.  These documents are consistent with Council’s public safety obligations, with the requirements of the Development Act and with all other relevant State and Federal authorities.

In addition to the Moveable Sign By-law, Council’s Sign, Banner and Flag policy emphasises a new approach to providing exemptions to the By-laws. These exemptions are based on a precinct concept. Council’s policy has seen precincts introduced to assist businesses in promoting themselves or the product they are advertising. 

The focus of the new Policy and By-law is to:

  • ensure the amenity of our townships and rural areas is maintained;
  • to provide guidance to local businesses and services through safe and appropriate signage;
  • to ensure fairness and equality to all businesses; and
  • to ensure the safety or road users.

To assist local business, sporting and community groups, Alexandrina Council is allowing an extended timeframe for affected operators to make alternative advertising arrangements as required.

As of April 2018, all non-compliant signage will be in breach of Council’s Policy and Moveable Sign By-law and as such, will be enforced as per Council’s Enforcement Policy.  There will be significant penalties for non-compliance which may include, but not limited to:

  • warning notices issued to non-compliant operators in the first instance;
  • expiations issued for failing to remove a non-complaint sign/s;
  • costs for removal, storage and/or disposal of non-compliant signs; and/or
  • prosecution

The following locations are considered to be precincts for the purpose of this policy:

  • Gardiner Street, Goolwa Industrial precinct
  • Goolwa Wharf precinct
  • Goolwa CBD precinct
  • Hill Street, Port Elliot Industrial precinct
  • Milang CBD precinct
  • Strathalbyn CBD precinct
  • Milne Road, Strathalbyn Industrial precinct

 Construction & Design

A moveable sign placed on a footpath area must:

  1. Be of a kind as an ‘A’ frame or sandwich board sign, an ‘inverted ‘T’ sign, a flat sign or, with the permission of the Council (which permission may, but is not required to be, in the form of guidelines published by the Council), a sign of some other kind.
  2. Be designed, constructed and maintained in good quality and condition.
  3. Be of strong construction and sufficiently stable or securely fixed when in position so as to keep its position in adverse weather conditions.
  4. Not have sharp or jagged edges or corners.
  5. Not, in the opinion of an Authorised Person, be unsightly or offensive in appearance or 
  6. Not move when in position or contain an animated display.
  7. Be constructed of timber, metal, plastic or plastic coated cardboard, or a mixture of such materials.
  8. Not exceed 900mm in height, 600mm in width and 600mm in depth.
    • In the case of an ‘A’ frame or sandwich board sign
    • Be hinged or joined at the top; and
    • Be of such construction that its sides are securely fixed or locked in position when erected.
  9. In the case of an inverted ‘T’ sign, not contain struts or members that run between the display area and the base of the sign.
  10. Not rotate, contain flashing parts or lights, or have balloons, flags, streamers or other things attached to it.

Placement

A moveable sign must not be:

  1. Placed on any part of a road apart from the footpath area.
  2. Placed on a footpath that is less than 2.5 metres wide.
  3. Placed within 1 metre of an entrance to any business premises.
  4. Placed on a sealed part of a footpath area unless the sealed part is wide enough to contain the sign and still leave a clear thoroughfare of at least 1.2 metres.
  5. Placed so as to:
    • Obstruct a vehicle door when opened, provided that the vehicle is parked lawfully on the road; or
    • Otherwise interfere with the reasonable movement of persons or vehicles using the footpath or road in the vicinity of where the moveable sign is placed.
  6. Placed any further than a distance of 5 metres from any boundary of the business premises which the sign advertises; placed on a landscaped area, other than landscaping that comprises only lawn.
  7. Placed within 5 metres of an intersection of two or more roads.
  8. Placed on any part of a footpath area, if there is an unsealed part of the footpath area on which the sign can be placed in accordance with this by-law.
  9. Placed on a designated parking area.
  10. Displayed during the hours of darkness unless it is clearly lit and the business to which it relates is open; or
  11. Placed in such a position or in such circumstances that, in the opinion of an Authorised Person, the safety of a user of the footpath area or road is at risk.

Restrictions

  • The owner or operator of a business must not cause or allow more than one moveable sign per street frontage of that business premises to be displayed on the footpath area or road at any time.
  • A person must not cause or allow a moveable sign to be placed on a footpath area unless;                       
    • It only displays material which advertises a business being conducted on premises adjacent to the moveable sign or goods and services available from that business premises; and
    • During ordinary business hours that the business premises to which it relates is open.
  • If in the opinion of the Council a footpath area is unsafe for a moveable sign to be displayed, the Council may prohibit or restrict the display of a moveable sign on such conditions as the Council thinks fit.

Unauthorised Signs

Persons responsible for moveable signs displayed contrary to these guidelines will be requested to remove them.  Failure to remove sign upon request will result in Council officers removing the sign.  Expiations and recovering fees will apply.

Vertical Banner Moveable Sign

Businesses may substitute a moveable sign of A-Frame or inverted T-style with a vertical banner sign (such as a feather, teardrop or blade wing type) where placement complies with the By-law (not the standard exemption), providing the vertical banner sign meets the following criteria.

Construction

A vertical banner sign displayed on a public street or road shall:

  • Be of a kind known as a feather, teardrop or blade wing sign
  • Be of a strong construction so as to be stable when in position and to be able to keep its position in adverse weather conditions, with no sharp or jagged edges or corners.
  • Be maintained in good condition so as not to present a hazard to any members of the public.
  • Not contain flashing parts.
  • Be a fabric sign with single mast
  • Have a solid or filled base weighing at least 25kg.
  • Banner mast must be constructed of carbon fibre or similar material, which is to be attached to a weighted base, so that they can be displayed without toppling over.
  • On a open verge – maximum flag size of 2.76m x 1m with a total height including stand of 3.5m.
  • On a footpath – maximum flag size of 2m x 1m with a total height including stand of 2.5m.
  • No more than 60cm wide below 2m.

Placement

Businesses located within the Council’s area are permitted by Council’s Sign, Banner and Flags Policy to place vertical banners on footpath areas, providing that they meet the following placement criteria.  Vertical banners must be:

  • Placed so as not to contact any structure, tree or object.
  • No more than one vertical banner per 5m of frontage, and exclude the use of an A-frame or T-frame sign, ie the business may opt to use a vertical banner or a moveable sign, but not both.
  • To be placed only on the immediate street frontage of the business (this excludes placement in locations permitted by standard exemptions detailed within Council’s sign, Banner and Flags policy.
  • Vertical banners may only be placed in compliance with Council’s By-law No 4 – Moveable signs, not within 5m of an intersection, only during hours of operation etc.

Restrictions

The sign shall:

  • Only display material which advertises the business or the products available from the business to which the sign related being conducted on commercial premises.
  • Not be in a position that places the safety of any user of the street or road at risk.
  • Not be displayed during the hours of darkness unless clearly visible.
  • Not be displayed on a median strip, traffic island or on a carriage way of a street or road.
  • Only be displayed when the business is open.
  • Not hinder pedestrian access along the street verge.
  • Not be placed at any point that is considered, in the opinion of an Authorised Person, to be a hazard.

Please note that it is the responsibility of the owner of the sign to ensure that the placement of signs is in accordance with Council’s Moveable Sign By-law and Sign, Banner and Flag policy. 

Unauthorised Signs

Persons responsible for placing Moveable signs contrary to By-law No 4 – Moveable Signs and Council’s Sign, Banner and Flag policy will be requested will be requested to remove them.  Signage that contributes to a proliferation may be removed by an Authorised Person to eliminate the proliferation.  Failure to remove a sign upon request may result in Council officers removing the sign.  Expiations and recovering fees will apply.
