Major Land Divisions

Generally major developer’s work on large property developments or large subdivisions. Major developments will often involve construction of roads and major infrastructure including pump stations. A major developer may need to enter into a Land Development Agreement. (Infrastructure Agreement).

If you enter into an Infrastructure Agreement (for wastewater services) with Council, you must engage an accredited consulting engineer to prepare detailed infrastructure designs and an accredited civil contractor to construct the infrastructure if required.

How long does it take?

Due to the numerous agencies involved and the various processes the application must go through, the division of land can take many months, sometimes even years. This fact must be taken into consideration in the early stages of the planning process.

The Land Division Application process including a connection to wastewater services takes the following steps ;

1. Preliminary enquiry at Local Council

2. Applicant to contact Land Surveyor and possibly Registered Conveyancer or Solicitor.

3. Lodgement of development Application with Plan SA on the ePlanning portal.

4. Plan SA refers the application to Council or State Government.

5. Council’s Planning department refer the application to the Wastewater Services team internally for assessment.

6. The Wastewater Services team will prepare a request for further information from the Consulting Engineer or applicant for design  drawings and other information as required, or add conditions as required if no additional information is needed.

7. Once the Wastewater Services team have acceptance of the drawings and relevant information requested, they will be able to calculate the development charges and requirements including (where required) an Infrastructure Agreement.  If an Infrastructure Agreement is required, this must be signed by all relevant parties and a copy will be forwarded to the Applicant.

8. Council’s Planning may issue an approval (subject to conditions).

9.  Applicant to meet all conditions of approval which may include but not limited to, payment of CWMS connection fees, CCTV footage if required, pressure testing, 'AS Constructed Plans, etc.

10. Applicant to request Clearance via the SA Plan portal 'Land Division Certificate'  to the Council's Planning Department.

11. Council's Planning Department check with relevant internal agencies (Wastewater Services) if all conditions have been met.

12. Council's Planning Department issue full development approval.

13. Lodgement at the Lands Titles Office

14. Examination of Plan and Documents

15. Deposit of Plan

16. Issue of Title/s.

Minor Land Divisions

Generally a minor land division is the dividing of one parcel of land into five or fewer separate parcels.

It is always recommended to speak to the Council’s Planning Department to determine whether the allotment can be subdivided prior to lodging an Land Development Application. Contact Planning on 08 85 55 7000.

Each Council area has a set of zoning rules, which determine how big or small the allotment can be. This will also determine the suitability of wastewater on the site. Eg; on-site waste disposal (Septic or Aerobic tank and soakage beds ) or if the allotment is connected to the Council’s Community Wastewater Management system.

Connection to an Existing Allotment

Within the Alexandrina Council area, many of the allotments are not serviced by the Community Wastewater Management System.
